Legal Question of the Month With Senior Staff Counsel Remy Barnwell
Question: A donor would like to make a gift of stock, and requests that the community foundation hold onto the stock for a period of time before selling it. Once we are able to make that sale, how do we determine the value of the stock?
Answer: As an initial matter, the donor cannot make a gift with any material restrictions including asking your foundation to hold the stock for a period of time.
Once the stock is received, your gift acknowledgement to the donor should list the high, low, and average price of the stock rather than providing the donor with a valuation because that can be construed as tax advice. For internal purposes, the value of the stock will be the fair market value (i.e., the price that the stock would sell for on the open market) on the day of contribution. If an endorsed stock certificate is mailed, that is the date of mailing and if it is delivered to a bank or broker to transfer to your foundation, then the date of contribution is the date the stock is transferred on the books of the corporation.

Advocacy Essentials for Community Foundations
As organizations committed to strengthening community foundations, we're partnering with CFLeads to offer a new public policy and advocacy training course for community foundations. This updated training will provide community foundation leaders and staff with the knowledge and resources needed to excel in advocating for the nonprofits and communities doing the hard work of social change.

Grant Program: Working Across Differences Accelerator
The Community Foundations Working Across Differences Accelerator provides the funding and tools necessary to design and implement strategies tailored to working across differences in local communities, including:
- Direct funding: Financial support to power local work, including a $20,000 planning grant and the potential for $45,000 in follow-on funding for early implementation.
- Capacity-building: Wrap-around support from expert coaches and a structured learning agenda to develop the skills and perspective to work across differences.
- Peer collaboration: Dedicated spaces to build relationships and share strategies with fellow community foundation leaders.
