Community Philanthropy Update

Greetings Friend,

As the year winds down, we hope you can find time to rest after an eventful 2024. Before our office closes for winter intermission, I wanted to share a new legal resource for community foundations and registration information for two Council convenings in 2025.

Legal FAQs 

So far this year, our legal resources team has answered more than 1,600 questions from Council members. After reviewing the most common topics and questions, we recently created a new Legal FAQ resource that includes pages for topics like donor-advised funds, disaster grantmaking, fiscal sponsors, global grantmaking, and end-of-year giving.

If you don’t see your question answered, Council membership provides 1-on-1 support from our team for issues related to governance, fund management, grantmaking, lobbying and political activity, self-dealing, and more. Members can email legal@cof.org for support.

Foundations on the Hill 2025 - February 23-26, 2025 in Washington, D.C. 

Foundations on Hill (FOTH), hosted and presented by United Philanthropy Forum and the Council on Foundations in partnership with Independent Sector, is the public policy and advocacy conference uniting the philanthropic sector to strengthen our collective voice on Capitol Hill. As we face a new administration and Congress, this year’s event will be focused on ensuring lawmakers better understand foundations and the issues that matter to us most. Registration is now open and we hope you’ll join to engage directly with legislators and policymakers through Hill and agency meetings.

Leading Locally 2025 – June 10-12, 2025 in Minneapolis-St. Paul 

Registration is now open for Leading Locally 2025 in Minneapolis-St. Paul June 10-12! Almost 500 community foundation staff attended Locally 2023 and can attest to the power of connecting with like-minded community and place-based funders, especially in times of national and global change. We received hundreds (!) of session ideas this fall and look forward to announcing speakers and session topics next year.

We can’t wait to see you at Foundations on the Hill and Leading Locally in 2025. For now, we wish you and your family joyful holiday gatherings and a happy New Year!

Resources You Can Use

Legal Question of the Month with Staff Counsell Remy Barnwell

Question: We have a 501(c)(7) sportsmen's club that is selling land to a forest conservancy. We have been asked to manage a portion of the proceeds as an endowment. I would like to know what the IRS's outlook would be on this arrangement. Obviously, we would need to make sure that no money that we distribute would be used to benefit individual members or to be used for any lobbying activities in which they might engage. 

Remy-Barnwell-1Answer: There’s no legal reason you couldn’t hold an endowment to benefit a 501(c)(7), or any other non-charity for that matter, but you’re correct that you’d need to take additional steps to ensure that all distributions from the endowment would further exclusively charitable activities carried out by the organization rather than supporting its general operations. This documentation could involve requiring the organization to submit funding proposals each time they request a distribution that would outline how they intend to use the funds to further specific charitable projects or activities, and then requiring follow up reporting detailing how funds were expended. And of course, you’d also need to stipulate that funds can’t be used to benefit members’ private interests or engage in lobbying and political activities, as you’ve noted.

2025 Community Foundation Cohort (ABFE/CFLeads)

ABFE and CFLeads are offering a free new cohort program in 2025 for community foundations to collaboratively engage with the Sustainable Development Goals (SDGs) and advance their racial equity agendas. Combining expertise and peer learning within participating organizations, the 2025 SDG Cohort will help institutions mobilize stakeholders, advance their missions, and increase impact and accountability.

The deadline to apply is tomorrow, December 20 at midnight E.T.!

Connecting Communities in the Americas, a CFLeads initiative, and Hispanics in Philanthropy partnered to create a guide for community foundations to build meaningful partnerships with Latine communities.
