| ### ![](https://email.cof.org/hubfs/Rebrand2022/happening-hill-icon.png?noresize)What We're Tracking in DC ## Census 2030 Proposed Regulations Last week, the **Census Bureau** and the **Department of Commerce** [released proposed regulations](https://www.federalregister.gov/documents/2026/09/10/2026-18481/decennial-census-of-the-population-of-americans-proposed-residence-criteria-and-proposed-regulations?utm_campaign=Washington%20Snapshot&utm_source=hs_email&utm_medium=email&_hsenc=p2ANqtz-9j5YljD6w4e6_DL_NP85R_U1mqG0KrXZbJzEQl5mp5sj4NrUTQsmgWfFxlHISSY_HSnDW1) regarding the decennial census in 2030 and beyond. The changes would: - Exclude noncitizens and non-lawful permanent residents in the apportionment count. This means refugees that have not yet attained permanent status, undocumented immigrants, and long-term but non-permanent residents (e.g. H-1B visa recipients) would not be counted. To identify who would not be eligible under these new rules, Commerce requests input on a question about legal status. - Establish a new definition of “usual residence.” - Prohibit the inclusion of demographic questions related to race, ethnicity, or sexual orientation in the decennial census questionnaire. The Bureau is accepting comments on the proposal through October 13. [In the hearing](https://financialservices.house.gov/calendar/eventsingle.aspx?EventID=411218&utm_campaign=Washington%20Snapshot&utm_source=hs_email&utm_medium=email&_hsenc=p2ANqtz-9j5YljD6w4e6_DL_NP85R_U1mqG0KrXZbJzEQl5mp5sj4NrUTQsmgWfFxlHISSY_HSnDW1), **Rep. Bryan Steil (R-WI)** praised Secretary Bessent’s [July speech](https://home.treasury.gov/news/press-releases/sb0566?utm_campaign=Washington%20Snapshot&utm_source=hs_email&utm_medium=email&_hsenc=p2ANqtz-9j5YljD6w4e6_DL_NP85R_U1mqG0KrXZbJzEQl5mp5sj4NrUTQsmgWfFxlHISSY_HSnDW1), as well as Treasury’s commitment to examining foreign funds used by nonprofits to fund political terrorism. Rep. Steil also stated his intent to continue investigations of nonprofits that misuse their tax-exempt status as the Chair of the House Administration Committee. - The **House Ways and Means Committee** favorably voted the [Digital Asset Tax Certainty Act (H.R.10357)](https://www.congress.gov/bill/119th-congress/house-bill/10357?hl=hr10357&s=1&r=1&utm_campaign=Washington%20Snapshot&utm_source=hs_email&utm_medium=email&_hsenc=p2ANqtz-9j5YljD6w4e6_DL_NP85R_U1mqG0KrXZbJzEQl5mp5sj4NrUTQsmgWfFxlHISSY_HSnDW1) out of the committee by a vote of 38-5. Among other provisions, the bipartisan legislation would exempt widely traded digital assets and U.S. dollar stablecoins from the qualified appraisal requirements for noncash charitable contributions. The letters accuse the nonprofits of profiting from their tax-exempt status when bringing litigation in federal courts. - Republicans on the **House Committee on Oversight and Government Reform** [sent a letter to Bloomberg Philanthropies](https://oversight.house.gov/release/comer-burlison-launch-investigation-into-bloomberg-philanthropies-funding-of-anti-american-energy-lawfare/?utm_campaign=Washington%20Snapshot&utm_source=hs_email&utm_medium=email&_hsenc=p2ANqtz-9j5YljD6w4e6_DL_NP85R_U1mqG0KrXZbJzEQl5mp5sj4NrUTQsmgWfFxlHISSY_HSnDW1) detailing concerns with the organization’s support of environmental organizations. - Reminder: on September 3, **Treasury and the IRS** released proposed regulations related to racial nondiscrimination requirements for private schools.
